A federal appeals court in New York ordered the US Food and Drug Administration to pay $1.3 billion in damages to consumers who allegedly purchased the drug Viagra over the past nine years, after a New York judge ruled that the agency had not met its burden of proof of the drug’s safety and efficacy.
The New York judge ruled that the agency had not met its burden of proof because its own experts had failed to establish that it would not be safe for consumers to use Viagra, according to a letter to the agency sent to attorneys representing plaintiffs in a class action brought by members of the class.
The FDA had asked for $3.1 million to resolve claims that its drugs were unsafe because of adverse drug reactions, which can result in heart attacks or strokes, and a $1.2 million settlement that the company had agreed to pay for litigation over the safety issues. The settlement was reached after the agency’s expert panel voted 11-4 to agree with the panel’s findings.
The agency had also asked for $2.2 million to resolve litigation involving safety concerns and its own experts. The panel’s decision was based on a review of evidence submitted by the agency and a letter to the panel. In its letter, the agency acknowledged that it was aware of the drug’s safety issues but had not provided any evidence of its own experts.
In an email, the company said that it would “continue to pursue” litigation about the safety of the drug. However, the agency was required to pay $1.3 billion to settle class-wide claims brought by members of the class who had filed claims in state court.
The New York court ruled that the FDA had met its burden of proof, finding that its own experts “cannot prove that Viagra is unsafe, and that the agency should not be required to pay damages to consumers who have suffered adverse drug reactions.”
The company had requested $2.2 million to resolve the litigation. The agency had also agreed to pay $1.3 billion to resolve the class-wide claims.
In its ruling, the court agreed with the agency that the agency had not met its burden of proof. The company’s expert panel “did not consider the evidence in determining that Viagra is not unsafe, and the FDA should not be required to pay damages to consumers who have suffered adverse drug reactions.”
The court also found that the FDA had “clearly established” that the drug is safe and effective. The agency had not made any findings on the safety issues or its own experts’ findings. The agency had not paid for any of its own experts’ services.
